DUI cases are NOT “all the same”. A criminal conviction is NOT “unavoidable”. 2. The road side examinations are 100% voluntary and you do not have to take part in any of these subjective tests. 3. Pursuant to Colorado’s express consent law – a driver in the state of Colorado is required to provide a blood or breath sample when properly requested and directed to do so by a law enforcement officer who has probable cause to make such request. If you refuse, you lose your license for a period of one year. 4. A breath test is, generally speaking, a less precise way to measure your blood alcohol content (BAC) than a blood test. This is because the breath testing machine, called an Intoxilyzer, is an indirect way to measure the actual level of alcohol in your blood. 5. If your drivers’ license is confiscated by the officer who arrested you, you have only seven days to take action to avoid revocation of your driving privilege by the Colorado DMV.
The precise level of alcohol in your blood matters. Colorado DUI law and Colorado Motor vehicle law provide different penalties for different blood alcohol levels. There are important “cutoff limits” at the BAC levels of .05, .08, .17, and .20. Even if it is your first DUI arrest, a blood alcohol content (BAC) of .08 or above triggers a Colorado DMV requirement that you install Interlock on your car for a period of 9 months. If you are arrested and facing charges for a drinking and driving offense and you have a prior conviction for either a DUI or DWAI, no matter how old, you are facing mandatory jail time. If you are a CU Student, the University will initiate campus disciplinary proceedings against you, even if your DUI did not happen on campus. CU has a “three strikes” policy for students with alcohol offenses. If you have had alcohol-related tickets in the past, you face more serious University penalties. If you are not a United States citizen, a conviction for any DUI-related offense can have serious immigration consequences.
